General terms and conditions of delivery

  • Assignments are issued in writing (by email), stating the purchase order number or cost center for invoicing purposes.
  • Quotations are valid until three months after the quotation date.
  • Our quotations are subject to the terms of delivery and payment of the Data & Insights Network (formerly: MOA) for market research.
  • Changes to the setup and planning during the research take place in consultation. Any additional costs will be communicated by Forum in good time.
  • All amounts stated are exclusive of VAT.
  • Forum retains the primary data for a period of at least 12 months and other research documents relating to the project for a period of at least 24 months, unless specifically agreed otherwise.
  • If the project involves the transfer of data that falls under the General Data Protection Regulation (GDPR), a Processing Agreement will be drawn up.
  • Forum uses encrypted email communication, and files containing data that falls under the GDPR will always be shared via Forum’s secure SharePoint environment.
  • Forum is certified for both ISO 20252 (market research quality standard) and ISO 27001 (information security quality standard).

Terms and conditions of delivery for the Performitor® dashboard

  • As part of the agreement, Forum grants the Client a non-exclusive license to use Performitor® and the custom configuration added to it.
  • The License applies for a fixed term and is automatically renewed for one year upon expiry, unless it is cancelled in writing no later than one month before expiry.
  • The License is granted solely for internal use by the Client’s employees.
  • Performitor®, the custom configuration, and the associated source code and executable code are and remain the property of Forum. The License extends only to the executable version of Performitor® and does not include the underlying source code(s).
  • The License is not transferable, sublicensable, divisible, or resalable. The License cannot be encumbered with limited rights.
  • The License entitles the holder to software updates.
  • Forum provides support in the use of Performitor®. The Client’s employees can contact the Forum Helpdesk for this;
  • Available during office hours on 073-6141425 or via helpdesk@forumresearch.nl.
  • Forum guarantees the continuity of service. Urgent malfunctions are resolved within one working day. In the exceptional case that this proves not to be possible, Forum will report this immediately to the Client’s contact person.
  • During the term of the Agreement, Forum will ensure a daily backup of the data processed with the application.
  • Forum carries out random checks on the integrity of data in the application and will inform the Client’s contact person if any errors or malfunctions are noticed in the integrity of the data.
  • Security is in accordance with the ISO 27001 standard. Performitor® is hosted in a Tier III data center of a hosting party based in the Netherlands.
  • All customer data supplied to Forum for the purpose of the research remains the property of the Client and will be treated as such by Forum. Ownership of all collected data also rests with the Client.
